1. GENERAL PROVISIONS

1.1. In accordance with Article 437 of the Civil Code of the Russian Federation, this document is an official public offer (hereinafter referred to as the ‘Offer’) by the SHIP FOR WORLD YOUTH LEADERS ALUMNI ASSOCIATION (hereinafter referred to as the ‘Contractor’) and contains all material conditions for the provision of services.

1.2. In accordance with Clause 2, Article 437 of the Civil Code of the Russian Federation, an individual or entity agreeing to the conditions described below and accepting the offer becomes a Customer. According to Clause 3, Article 438 of the Civil Code of the Russian Federation the acceptance of the offer is equivalent to signing the contract on the provision of services under the conditions described in this Offer (hereinafter referred to as the ‘Contract’).

1.3. Based on the above, read the text of this public offer carefully; and if you do not agree with any paragraph of the offer, the Contractor suggests you reject the use of the services.

2. SUBJECT OF THE OFFER

2.1. The subject of this Offer is the provision to the Customer of the services associated with the organization of participation at the Global Assembly in Moscow (hereinafter referred to as the ‘Event’), in the manner and on the conditions specified in this Public Offer.

2.2. This Public Offer, as well as the additions to this public Offer, which are its integral part, shall be published by the Contractor on his website at http://ruswyaa.org/

2.3. The Contractor may unilaterally change the conditions of this Public Offer, without receiving the Customer’s prior consent, provided that the updated conditions are posted at http://ruswyaa.org/ not later than one day before they become effective.

2.4. The Contractor has the right to notify the Customer via the e-mail addresses provided by the Customer on changes in volume, range, granting conditions, provided services, and also has the right to notify regarding new services provided by the Contractor.

2.5. The Contractor has the right to take photos and/or videos on the premises of the event execution, including the venue of the evening program, and the Customer gives to the Contractor the unconditional and irrevocable consent to publication and further use of the images of the Customer (including his photos and video footage), processing and use of the received photo and video content with images of the Customer in any purposes which are not forbidden by the legislation of the Russian Federation without payment of remuneration.

3. SERVICE DESCRIPTION

3.1. According to the subject of this Offer, the Contractor undertakes to provide the Customer with the services which are named and specified in this Offer, and the Customer, in case of the acceptance of the offer, undertakes to pay the specified services in the manner and on the conditions specified in this Offer.

3.2. Date of the Event: 31.08.2019 — 05.09.2019

4. PERSONAL DATA PROCESSING

4.1. By filling in his/her own personal data and personal data of his/her employees, for whom the application for participation in the Event is made out, during the registration and execution of the application for the Event in the form found on the Contractor’s website, the Customer gives consent to processing of personal data by the Contractor, both with and without the use of the automation equipment.

4.2. Hereby the Customer confirms that he transfers the entered personal data of his/her own and of his/her employees, for whom the application for participation in the Event is formed, for processing by the Contractor and agrees to their processing. The Customer is also notified that processing of his/her personal data will be carried out by the Contractor on the basis of Clause 5, Part 1 of Article 6 of Federal Law of 27 July 2006 No. 152-FZ «Concerning Personal Data» (in edition of 25.07.2011) and also on the basis of Clause 1, Part 1 of Article 6 of Federal Law of 27 July 2006 No. 152-FZ «Concerning Personal Data» (in edition of 25.07.2011), and, as such, the Customer, if necessary, gives consent to processing of personal data.

4.3. The Customer agrees to the Contractor’s processing of the following personal data:

4.3.1. Surname, name, middle name;

4.3.2. Birth date and birth place;

4.3.3. Country, region and city of residence;

4.3.4. Contact telephone numbers;

4.3.5. E-mail address;

4.3.6. Links to the user profiles in social networks;

4.3.7. Profile picture (user image).

4.4. The purpose of processing of personal data is the execution by the Contractor of conditions of the relevant contracts, as well as carrying out advertizing campaigns and market research.

4.5. During the processing the following actions will be applied to the personal data: collecting, recording, systematization, accumulation, storage, specification (updating, change), extraction, use, transfer (distribution, granting, access), depersonalization, blocking, removal, erasure.

4.6. Transfer of personal data to the third parties is carried out according to the current legislation of the Russian Federation and agreements between the Contractor and the Customer.

4.7. By registering on the website of the Contractor at http://ruswyaa.org/ and submitting the application for participation in the Event, the Customer agrees that the personal data of his/her own and of his/her employees, for whom the application for participation in the Event is formed, become available to the Contractor and the Contractor’s collaborators at this Event.

4.8. Personal data are processed before the termination of the Contractor activity. Storage of personal data is carried out according to Federal Law No. 125-FZ «About archiving in the Russian Federation» and to laws and regulations in the field of archiving and archival storage.

4.9. Consent to the use of personal data can be withdrawn by the Customer by means of a written statement sent to the Contractor’s e-mail address Info@ruswyaa.org

4.10. In case of Customer’s withdrawal of consent to processing of personal data the Contractor has the right to continue processing of personal data without the Customer’s consent in the presence of the bases specified in Clauses 2 –11, Part 1 of Article 6, Part 2 of Article 10 and Part 2 of Article 11 of Federal Law of 27 July 2006 No. 152-FZ «About personal data» (in edition of 25.07.2011).

4.11. Contractor’s personal data processing policy is public according to requirements of Part 2 of Article 18.1 of Federal Law of 27 July 2006 No. 152-FZ «About personal data» (in edition of 25.07.2011) and is constantly located at the web address http://ruswyaa.org/

5. CONDITIONS AND ORDER OF THE PROVISION OF SERVICES

5.1. Having studied the Offer and having chosen the type of service, the Customer sends to the Contractor’s address the application for services provision (that is the acceptance of the Offer), according to the form given at the website http://ruswyaa.org, after which the Contract for provision of services is considered finalized.

5.2. On the basis of the received application the Contractor presents the Customer with the invoice for payment of the chosen service.

5.3. After Customer transfers money onto the settlement account of the Contractor the Contract comes into force.

5.4. Services are considered provided properly and in full if the Customer does not expose a motivated claim within three working days from the moment of the end of providing services. In case of lack of a motivated claim, the act of the provided services is considered signed, and the services are considered provided properly. The claim is considered as motivated if the Event was not held in the period stated in pargraph 3.2. of the present Offer, and the Contractor did not post the relevant information on change of time frame of the Event on the website http://ruswyaa.org/.

5.6. Other conditions of providing services are given in paragraphs 6-8 of the present Offer.

6. COST OF SERVICES. PAYMENT PROCEDURE

6.1. All of the Contractor’s services are provided on the basis of 100% of an advance payment. Payment has to be made on the basis of the corresponding invoice for payment which is presented by the Contractor to the Customer (paragraph 5.2. of the present Offer) at the time specified in the invoice.

6.2. Payment of the services provided by the Contractor is made onto the currency account of the Contractor.

6.3. Customer’s obligations for payment are considered fulfilled properly on the day of full and complete money transfer onto the settlement account of the Contractor.

6.4. In case the Customer cancels participation in the Event before June 30th, 2019, the participant gets refunded with 50% of payment. In case the Customer cancels participation after June 30th, 2019, the payment is not refunded.

6.5. The following is included into the cost of services: accompanying (distributing) materials (a brochure with theses, a notebook for records, a pen), food supplied by the Contractor, accommodation, the excursion program and also tenancy for executing the Event.

7. 7. FORCE MAJEURE CIRCUMSTANCES

7.1. The party is exempted from liability under the present contract if proves that appropriate implementation of terms of the contract was impossible owing to force majeure circumstances, emergency and unpreventable circumstances in given conditions (natural disasters, military operations).

8. VALIDITY OF THE CONTRACT

8.1. The contract shall become valid upon the moment specified in paragraph 5.3 of the present Offer and shall remain in effect until the Contractor’s complete and full implementation of the obligations stated in this Offer. Obligations of the Contractor are considered fulfilled fully and properly by the end of the Event (paragraph 5.4. of this Offer).

9.1. All disputes and disagreements are solved by negotiations. In case disputes and issues cannot be settled by negotiations, they are submitted to the Arbitration court of Moscow.
